Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Monitorion platform ("Service") provided by Monitorion ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1The Service
Monitorion is a monitoring-as-a-service platform that provides website, API, and infrastructure monitoring, including:
- HTTP/HTTPS, Ping, Port, DNS, SSL, Domain Expiry monitoring
- Content change, security headers, mixed content, blacklist checks
- Heartbeat / cron job monitoring
- SMTP, WebSocket, GraphQL, Sitemap, Broken links, Lighthouse audits
- Multi-channel alerting — email, SMS, webhooks, Slack, Discord, Telegram, Teams, Google Chat, PagerDuty
- Public status pages, incident management, SLA reports
- Multi-region checks, team collaboration, and private network workers

2Account Registration
You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Keep your password secure and confidential
- Notify us immediately of any unauthorized use of your account
- Not share your account credentials with unauthorized individuals
You must be at least 16 years old to use Monitorion. By registering, you confirm you meet this requirement.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
3Subscription & Billing

Annual plans are billed upfront at approximately 20% discount. Prices are in USD and exclude any applicable taxes. All payments are processed by Paddle, our Merchant of Record, who handles billing, invoicing, and tax calculation.
- Renewal: subscriptions renew automatically until cancelled
- Refunds: 14-day money-back guarantee for new paid subscriptions. Refund requests are handled by Paddle in accordance with applicable consumer protection laws
- Cancellation: cancel anytime via billing settings; access continues to end of period, after which your account reverts to the free plan
- Failed payment: we will retry 3 times; service may be downgraded to Free if payment continues to fail
- Price changes: we will notify you at least 30 days before any price increase; changes do not apply to your current billing cycle
SMS Credits. SMS alert credits are included with paid plans as specified in your tier. Additional SMS bundles may be purchased separately. Unused SMS credits do not roll over between billing periods.
Free Plan. The free plan provides limited access at no cost and requires no credit card. The free plan may be modified or discontinued with 30 days' notice.
4Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use Monitorion to:
- Monitor websites, servers, or services you do not own or have explicit authorization to monitor
- Conduct denial-of-service attacks, vulnerability scanning, or penetration testing against third-party systems
- Configure monitors at intervals designed to overwhelm or degrade the target service, or create thousands of near-identical monitors to circumvent limits
- Collect, store, or transmit personally identifiable information of third parties without their consent
- Reverse-engineer, decompile, disassemble, or scrape any part of the Service
- Resell, sublicense, or redistribute the Service without our prior written consent (except for white-label features included in the Agency plan)
- Transmit malware, spam, or any harmful content through webhooks or alerts
- Use the Service in any manner that could interfere with, disrupt, or negatively affect the platform or other users, or that violates any applicable law or regulation
Violation may result in immediate account suspension without refund.
5Infrastructure & Reliability
We take reliability seriously. Monitorion is built on modern, enterprise-grade technology and operated using industry best practices for high availability:
- High-availability architecture: our infrastructure is designed with redundancy at every layer — multiple application instances, load balancing, and automated failover to eliminate single points of failure
- Enterprise database: we use Supabase (PostgreSQL) with automated backups, point-in-time recovery, and high-availability replication
- Process management: all services run under PM2 cluster mode with automatic process restart and crash recovery
- Security-first: HTTPS/TLS encryption on all connections, Row-Level Security (RLS) on all database tables, API key hashing, Content Security Policy headers, and regular dependency updates
- Multi-region workers: monitoring checks are distributed across multiple geographic locations to reduce latency and avoid regional network issues
- Self-monitoring: our own infrastructure is continuously monitored for health, queue depth, worker availability, and response times
- Continuous delivery: we apply security patches, dependency updates, and improvements on an ongoing basis with zero-downtime deployments
- Data backups: automated daily backups with verified restore procedures
- Incident response: we maintain a public status page at status.monitorion.com and communicate incidents in real time
While we invest significantly in reliability and apply industry best practices, no internet service can guarantee 100% availability. Despite our best efforts, unexpected failures can occur. The limitations of liability described in section 11 apply even when we have taken all reasonable precautions.
5aService Level Agreement
Target uptime (paid plans): 99.9% per calendar month, excluding scheduled maintenance and third-party failures.
If we fall below this target, paid customers may request a service credit:
- 99.0% – 99.9% uptime — 10% credit of monthly fee
- 95.0% – 99.0% uptime — 25% credit
- Below 95.0% uptime — 50% credit
Credits must be requested within 30 days of the incident and are applied to the next billing cycle. The Free plan carries no SLA or uptime guarantee.
Exclusions. The SLA does not apply to: (a) free-plan accounts, (b) outages caused by factors outside our reasonable control (force majeure, internet infrastructure failures, third-party service outages), (c) features labeled as beta or experimental, or (d) abuse or violation of these Terms.
Check intervals are approximate and may vary by up to 10%. We are not liable for alerts missed due to third-party delivery failures (email providers, SMS carriers, etc.).
6Data & Privacy
Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, and protect your data. Key points:
- You retain ownership of all data you input and all monitoring results
- We do not sell your data to third parties
- You may export or delete your data at any time
- Check history is retained per your plan tier (see Privacy Policy for details)
7Intellectual Property
The Service, including all software, content, design, trademarks, and documentation, is owned by Monitorion and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose during the subscription term.
You retain ownership of all data you provide to the Service, including monitor configurations, check results, and account information. You grant us a limited licence to process this data solely for the purpose of providing the Service.
You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.
Private Worker (OSS). The Monitorion private worker is released under the MIT License. The terms of that licence govern your use of the private worker software.
8Termination
By you: cancel your subscription at any time via billing settings or by contacting us at [email protected]. Access continues until the end of your paid period.
By us: we may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or fail to pay after repeated attempts. We may also discontinue the Service entirely with 90 days' advance notice to active paid subscribers.
Effect of termination: upon termination, your right to use the Service ceases. Your data is retained for 30 days to allow for export, after which it is permanently deleted (unless legally required to retain it).
9Nature of Service
Monitorion is a monitoring and notification service only. We observe the availability and performance of services you configure and report the results to you. We are not a hosting provider, infrastructure operator, or guarantor of the services you monitor.
We are explicitly not responsible for:
- The uptime, availability, or performance of your monitored services or infrastructure
- Any business losses, revenue loss, or user impact resulting from downtime of the services you monitor
- Any actions taken (or not taken) based on monitoring data or alerts received through Monitorion
- Decisions made by you or your team in response to (or in the absence of) alerts
- The accuracy, completeness, or timeliness of monitoring data in all circumstances
Monitorion is a tool to help you stay informed — you remain solely responsible for your own infrastructure, applications, and the services you operate.
10Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
In particular, we do not guarantee:
- That every monitor check will fire at exactly the configured interval
- That all alerts will be delivered (delivery depends on third-party email, SMS, and webhook providers)
- That monitoring results are free from false positives or false negatives
- That the service will remain available during scheduled or unscheduled maintenance
11Limitation of Liability
To the maximum extent permitted by applicable law:
- Monitorion shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of revenue, loss of data, loss of goodwill, or business interruption
- We are not liable for damages arising from downtime or failures of our own infrastructure, including server outages, network failures, database unavailability, or any other technical failure on our end
- We are not liable for missed, delayed, or duplicate alerts regardless of cause
- We are not liable for losses caused by false positives or false negatives in monitoring results
- We are not liable for failures or outages of third-party services (Supabase, Resend, Vonage, Paddle, cloud providers, or internet infrastructure)
- We are not liable for any consequence of your reliance — or failure to rely — on monitoring data or alerts
Our total aggregate liability for all claims arising under or related to these Terms shall not exceed the greater of (a) the total fees you paid us in the 12 months immediately preceding the claim or (b) EUR 100.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud or death/personal injury caused by negligence). In jurisdictions that do not allow exclusion of certain warranties or limitation of liability, our liability is limited to the minimum extent permitted by law.
12Force Majeure
Monitorion shall not be liable for any failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, acts of God, pandemics, or epidemics
- Acts of government, war, civil unrest, or terrorism
- Internet outages, DDoS attacks, or widespread infrastructure failures
- Failures of third-party cloud providers, data centres, or network operators
- Power outages or utility failures affecting our hosting infrastructure
- Cyberattacks, data breaches, or security incidents outside our reasonable control
In such events we will use commercially reasonable efforts to restore service as quickly as possible and will communicate status updates via our status page.
13Indemnification
You agree to indemnify and hold harmless Monitorion, its employees, and contractors from any claims, damages, losses, or costs (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your infringement of any third-party rights, or (d) the content or data you provide to the Service.
14Governing Law
These Terms are governed by the laws of the Czech Republic and the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Czech Republic, unless mandatory consumer protection laws in your country of residence provide otherwise.
15General Provisions
Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement. These Terms, together with the Privacy Policy and any applicable order forms, constitute the entire agreement between you and Monitorion regarding the Service.
Waiver. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
16Changes to Terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notification at least 30 days before taking effect. Continued use after the effective date constitutes acceptance of the updated Terms.
